Terms and Conditions
The following Terms and Conditions have been revised to reflect recent changes in consumer protection and data‑protection law in the UK, India and the United States. They replace all prior versions and apply to our Competitions and to Courses. Please also refer to our separate Privacy Policy, Cookie Policy and Code of Conduct, which form part of these Terms but are set out on dedicated pages for clarity.
Definitions
We / Us / Our / SkillStorm – In My Academy Ltd, a company registered in England and Wales.
You / Your – The individual or organization entering into a contract with us. Where the participant is a child or minor, “you” means the participant and their parent or legal guardian jointly.
Competition – Any contest, prize draw, challenge or other competitive event operated by In My Academy.
Course – Any pre‑recorded, live or blended learning Programme delivered by In My Academy.
Digital Content – Competition materials, course videos, downloads or other electronic materials provided by us.
Key Changes in This Version
1.Parental and Guardian Consent – We have clarified that children under 13 years old cannot consent to the collection and processing of personal data under UK GDPR Article 8; a parent or guardian must consent on their behalf[1]. Under Indian contract law, any agreement with a minor under 18 years is void unless it is for the minor’s benefit[2]; therefore a parent or legal guardian must enter into the contract on behalf of anyone under 18. In the United States, we comply with the Children’s Online Privacy Protection Act (COPPA); operators must obtain verifiable parental consent before collecting, using or disclosing personal information from children under 13[3].
2.Digital Content Cancellation Rights – We have updated our refund policy to align with UK Consumer Contracts Regulations 2013. Digital content must not be supplied during the statutory 14‑day cooling‑off period unless you expressly request early access and acknowledge that this waives your right to cancel[4]. Once you download or stream the digital content after consenting, your right to cancel is lost. This applies to both competition materials and course videos. We will not provide access until we have received this express consent or until the cooling‑off period has expired. This change is also designed to anticipate the Digital Markets, Competition and Consumers Act 2024 which introduces stronger pre‑contract information requirements for subscriptions from 2026.
3.Privacy & Data Protection – We have separated our data‑handling obligations into a Privacy Policy. These Terms summarise key points: we process personal data in accordance with UK GDPR and Data Protection Act 2018, and also comply with COPPA and the Indian Digital Personal Data Protection Act 2023 where applicable. We have added specific rights for parents to review and delete their child’s data[5].
4.Minor Contracts – For participants in India, contracts entered into by minors are void unless they are for the minor’s benefit[2]. Education‑related contracts generally benefit minors and may be valid, but to avoid uncertainty we require a parent or guardian to create the account and accept these Terms. For participants elsewhere we follow similar principles and require parental consent for anyone under the age of majority. You represent and warrant that you have authority to bind any minor participant you register.
5.International Users – We recognise that participants from outside the UK may have additional consumer rights under their local laws. Nothing in these Terms intends to deprive you of mandatory protections under your local consumer law. Where these Terms conflict with non‑waivable consumer protections in your jurisdiction, those protections will take priority.
1. Competition Terms and Conditions
1.1 Eligibility & Registration
Competitions are open to eligible participants as described in the specific competition rules. Unless the rules specify otherwise, participants must be aged 18 or over or have a parent or legal guardian register and accept these terms on their behalf. Under UK GDPR, children aged 13–17 may consent to data processing themselves only if the service is not specifically directed at children and the processing is lawful; children under 13 require parental consent[1]. Under Indian law, minors cannot contract on their own[2]; therefore all participants under 18 from India must have a parent or guardian create the account and accept these Terms.
By registering, you confirm that all information you provide is true and accurate. We reserve the right to disqualify any entrant who provides false information, violates these Terms or the spirit of the competition, or engages in fraud or misconduct.
Each individual may enter only once per competition unless we explicitly permit multiple entries. Automated or bulk entries are prohibited.
1.2 Parental Consent and Age Verification
When a competition is open to minors, parents or legal guardians must complete the registration and provide verifiable consent to our processing of their child’s data. For participants in the United States, we comply with COPPA and will obtain verifiable parental consent before collecting, using or disclosing personal information from children under 13[3]. Parents may review their child’s information, request its deletion and refuse any further collection. We do not condition a child’s participation on the collection of more data than is reasonably necessary to participate[5].
We may take reasonable steps to verify the age of participants and that consent has been given by someone with parental responsibility[1]. If you misrepresent a minor’s age or fail to obtain appropriate consent, we may terminate participation and void any prizes.
1.3 Competition Entries & Intellectual Property
You must own or have permission to use any content you submit. You grant In My Academy a non‑exclusive, worldwide, royalty‑free licence to use, edit, display and distribute your competition submissions and any recordings of your participation for the purposes of administering the competition and promoting our programmes. We will not include personal identifying details of minors (such as surnames, addresses) in marketing material without separate permission.
You warrant that your entries are original and do not violate any third‑party rights. You agree to indemnify us against any claims arising from your breach of this warranty.
1.4 Prizes
Prize details are set out in the individual competition rules. We guarantee that a prize will be awarded if the competition proceeds to completion but reserve the right to substitute a prize of equal or greater value if circumstances require it. Non‑cash prizes are not exchangeable for cash.
Winners are responsible for any taxes or duties on prizes. Winners may be required to provide proof of identity, eligibility and parental consent (if applicable).
If you fail to claim a prize within the specified timeframe or if we cannot verify your eligibility, we may select an alternate winner.
1.5 Refunds & Cancellations (Competitions)
Cooling‑Off Period: For competitions with an entry fee, you may cancel your entry within 14 days of registration provided you have not started the competition or accessed any competition materials. We will not supply digital content during this period unless you expressly request early access and acknowledge that you lose your right to cancel[4]. If you do not give this consent, we will delay access until the cooling‑off period ends. Once you begin participating or download any materials after giving consent, your right to cancel is lost.
After Participation Begins: No refunds will be given once you have accessed competition materials or begun the competition, except as required by law or at our discretion.
We Cancel or Modify: We may cancel, modify or postpone a competition for reasons outside our control (e.g. technical issues, insufficient entries, pandemics). If we cancel before the competition starts, entry fees will be refunded. Our liability is limited to refunding entry fees; we are not liable for other costs incurred by participants.
1.6 Use of Personal Data & Publicity (Competitions)
We process personal data as explained in our Privacy Policy. We will handle all personal information in accordance with the UK GDPR, Data Protection Act 2018, COPPA and other applicable laws. Parents of children under 13 have the right to review their child’s data, request deletion and refuse further use[3].
By entering, you consent to us announcing your first name, last initial and general location for publicity purposes. For minors, we will seek separate consent from a parent or guardian before publicly sharing any images or video of the child.
We will not transfer your personal data to third parties except as necessary to administer the competition (e.g. payment processors, event hosts) or as permitted by law. Full details are in our Privacy Policy.
1.7 Third‑Party Platforms & Services (Competitions)
Competitions may involve the use of third‑party platforms such as YouTube or Zoom. These platforms are not sponsors of our competitions and have their own terms of service and privacy policies. You must comply with those terms. We are not responsible for the availability of third‑party services or for any loss arising from their failure.
Payment processing is handled by reputable third‑party processors; we do not store your full payment details. Currency conversion is performed by your bank or the payment gateway; we are not liable for exchange rate differences.
1.8 Limitation of Liability (Competitions)
Competitions are provided “as is” and “as available”. Except for liability that cannot be excluded by law, we exclude all implied warranties and limit our liability to the entry fee paid or the value of the prize, whichever is greater[4]. We are not liable for indirect or consequential losses arising from participation.
You agree to indemnify us for any losses arising from your breach of these Terms.
1.9 Governing Law (Competitions)
These competition terms are governed by English law and you submit to the exclusive jurisdiction of the courts of England and Wales, except that consumers residing outside the UK may also bring proceedings in their local courts where required by law. Nothing in these Terms deprives you of mandatory protections in your home jurisdiction.
2. Course Terms and Conditions
2.1 Enrollment & Eligibility
Courses are offered to individuals who register and pay the required fee. You must provide accurate information and must not share your login details. Each license is personal to you.
Minors & Parental Consent: If you are under the age of majority in your country (18 in most jurisdictions), a parent or guardian must register and accept these Terms. Under UK GDPR, children under 13 cannot consent to data processing; for children aged 13–17, parents should still supervise enrolment[1]. Under Indian law, contracts with minors are void unless for their benefit[2]; therefore guardians must contract for minors. Under U.S. COPPA, we obtain verifiable parental consent before collecting data from children under 13[3].
We reserve the right to refuse or cancel enrollment if you are ineligible or violate these Terms.
2.2 Course Content & Access
Upon enrollment, you will have access to the course materials either on a fixed schedule or on demand. Our courses are pre‑recorded but may include live sessions at our discretion.
14‑Day Cooling‑Off and Express Consent: We will not provide full access to digital course content during the statutory 14‑day cooling‑off period unless you expressly request early access and acknowledge that you lose your cancellation right[4]. If you do not request early access, we will delay access until the cooling‑off period ends.
You may stream or download course materials solely for your personal educational use. You must not copy, share, sell or publicly display any course content. We retain all intellectual property rights.
We may add or remove content, reschedule live sessions or update materials. If we record live sessions, by participating you consent to us using the recordings for course participants and quality monitoring.
2.3 Payments & Pricing
Course fees are payable in advance. Prices are normally listed in GBP; your payment provider may convert to your local currency at their rates. We are not responsible for exchange rate differences or foreign transaction fees.
Payment processing is via third‑party gateways; we do not store your full payment details.
2.4 Refund Policy (Courses)
Cooling‑Off Period: From the date of enrollment (or the date you receive access details), you have 14 calendar days to cancel and obtain a full refund provided you have not accessed the course content[4]. We will not supply digital content during this period unless you expressly request early access and acknowledge that you lose the cancellation right.
After Access Begins: Once you access or download digital course content after giving express consent, you waive your right to cancel and refunds will not be given except at our discretion or if required by law.
To cancel within the cooling‑off period, you must notify us in writing. We will process refunds within 14 days of receiving your notice, less any reasonable deductions for services performed.
If you purchase a subscription or payment plan, additional cancellation rights may apply under the Digital Markets, Competition and Consumers Act 2024 once the subscription rules come into force. We will update our policies accordingly.
2.5 Third‑Party Services (Courses)
We use third‑party platforms (e.g. YouTube, Vimeo, Zoom, Discord) to deliver course content and community interactions. These platforms have separate terms; you must comply with them. We are not responsible for platform outages or data breaches on their end. If a platform fails, we will provide alternative access where reasonably possible.
2.6 Code of Conduct & User Behaviour
You must behave respectfully towards instructors and other learners. Harassment, discrimination, hate speech or disruptive behaviour will result in removal from the course without refund.
You must not upload unlawful, infringing or inappropriate content. If you submit assignments or projects, they must be your own work (or collaborative where allowed). Plagiarism and cheating are grounds for removal.
2.7 Disclaimers & Limitation of Liability (Courses)
Our courses are for educational purposes and we do not guarantee specific outcomes (e.g. employment, exam results). Course content is provided “as is”. We exclude implied warranties and limit our liability to the amount you paid for the course, except for liability that cannot be excluded by law[4].
You are responsible for ensuring that the course is suitable for your needs. We do not provide medical, legal or financial advice. Where courses involve physical activity, you should consult a professional before participating.
2.8 Governing Law (Courses)
These course terms are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers outside the UK may bring proceedings in their local courts as required by law. Mandatory protections under your local law will take precedence.
2.9 Miscellaneous
If any provision of these Terms is found to be invalid, the remaining provisions remain in force. Our failure to enforce any provision is not a waiver. We may update these Terms; we will notify you of significant changes, and continued participation constitutes acceptance of the updated terms.
Please read our Privacy Policy, Cookie Policy and Code of Conduct for further details on how we handle data and expectations of behaviour.
